Instruction Guide For Stormwater Exemption Request

When the scope of work involves any regulated activities including, but not limited to, earth disturbance by constructing new buildings or structures, or adding to existing buildings or any activities that may affect stormwater a SWM Site Plan and Report are required, unless specifically exempted by means of a stormwater exemption application submitted to the Building Code Official for review and approval before the building permit application is reviewed.

Regulated Activities:

Regulated activities by definition include any earth disturbance activity or any activity that involves the alteration or development of land in a manner that may affect stormwater runoff.

Projects that create an impervious surface that prevent the infiltration of water into the ground shall by definition include, but not be limited to, roofs, additional indoor living spaces, patios, garages, storage sheds and similar structures and any new streets and sidewalks. Decks, parking areas, and driveway areas are not counted as impervious areas if they do not prevent infiltration. Proposed gravel shall by definition be considered impervious whereas existing gravel conditions are considered to be pervious.

For all regulated activities an approved Stowmwater Management Site Plan indicating how stormwater runoff will be managed within the project is required unless specifically exempted.

Exempt Activities:

In accordance with Chapter 26 Part 1C section §113(6) Forest management and timber operations are exempt from the rate and volume control requirements and SWM site plan preparation requirement provided the activities are performed according to the requirements of 25Pa Code Chapter 102.

In accordance with Chapter 26 Part 1C section §113l (7) Agricultural activities are exempt provided the activities are performed according to the requirements of 25Pa Code Chapter 102.

BEFORE COMPLETING THE STORMWATER EXEMPTION APPLICATION, THE STORMWATER EXEMPTION REQUEST WORKSHEET MUST BE COMPLETED IN ORDER TO DETERMINE IF THE EXEMPTION QUALIFIES

The Stormwater Exemption Request shall include the following:

  • SWM Exemption fee consistent with the fee schedule shall be calculated by the Code Official and shall be paid prior to reviewing the exemption application.

  • Third Party plan review costs are not included as part of the SWM Exemption Request fee.

  • Owner/applicant is responsible for Third Party plan review costs

  • Third Party inspections are required for all work

  • Third Party inspection costs are not included as part of the SWM plan review fee

  • Owner/applicant is responsible for Third Party inspection fees

  • A copy of all Third Party inspection(s) shall be provided to the Township

Note:

For those projects requiring a zoning permit, the stormwater exemption application will not be reviewed until the zoning permit is issued.
